Mediation in Big Island Family Cases

Very few family law cases are decided by a judge after a trial. The overwhelming majority settle, and mediation is the structured setting where that most often happens. A neutral third party sits between both sides, moves offers back and forth, and tests each position against what a court would likely do. The mediator does not decide anything, which is the point: you keep control of the outcome.

What Mediation Is Good At

  • Parenting plans, schedules, holidays, and exchange logistics
  • Dividing property and debt
  • Support, where the dispute is about inputs rather than the formula
  • Post-decree disagreements that do not need a full modification case

It is usually faster and considerably cheaper than litigating, and it keeps your finances out of the public record. For parents who will be dealing with each other for another decade, it also sets a better precedent than a courtroom fight.

Going In Prepared

Mediation rewards preparation and punishes improvisation. Before the session you want a complete financial picture, a clear sense of what you actually need as opposed to what you would like, and a realistic read on what the Family Court would likely order if you did not settle. That last piece is where having an attorney in your corner matters most, because an offer only looks good or bad relative to the alternative.

When It Is the Wrong Room

Mediation assumes two people negotiating in good faith with equal information and equal footing. Where there is a history of abuse or intimidation, where one spouse controls all the financial information, or where assets may be hidden, the process can entrench an unfair result rather than fix it. Those cases need a different approach, and it is worth saying so early.
